Terms of Service

By commissioning me, you are agreeing to my terms of service below.

I. GENERAL TERMS & INFO

• I reserve the right to decline or discontinue a commission at any point if I feel uncomfortable drawing it or if you have been proved disrespectful/troublesome in anyways.

• You are only purchasing my services and digital artworks.

• I own the work I do whether it is art or rigging, I am allowed to do what I want with it (Ex: Posting it on my own social media like Twitter or Instagram, and future Portfolios. I will always put proper credits to you if I do so!)

• It is first come first serve.

• You are allowed to ask me for WIP at any point within the process, please do not spam. (Example: Asking on a daily basis for updates)

• You are responsible for providing clear references.

• You may re-post the art/rigs from me with proper credit and do not claim it is your art/rigging!

• Please do not ask me to lower my prices.

• The client may not edit the artwork without permission from the artist. (Ex: Removing my watermarking, coloring the sketch, or painting over it) Unless otherwise.

• A majority of the commissions will be streamed unless the client wishes it to not be.

I, the artist, am not responsible if the client has failed to read the terms of service that I have provided on this page.

II. PAYMENT

• All commissions must be all paid full upfront or once the sketch has been approved (Whichever is comfortable with you).

• Payment is only through Paypal (USD).

• COMMERCIAL PURCHASE: If you want to sell my art as merchandise, there is a 3x fee of the original price! If you are using my rigs for commercial use there is a 3x fee of the original price as well.

III. PROCESS

• Once payment has been received, I will start on the sketch, or I will start coloring if you are paying after the sketch.

• For rigs please send me a PSD file of the work you need me to do, whether the parts are split up by themselves or as is and I will start working once payment and file have been received.

• Once the sketch has been approved, I will start going much further with the work.

• Throughout the process, I will be sending WIP at each stage. Once it has been confirmed I will continue on.

• After the commission has been completed, I will send it through VIA Twitter, Email, or Discord.

• The files you will receive will be one of the following: JPEG, PNG, MP4, Web.m, or GIF.

IV. SATISFACTION AND CHANGES

• My priority is to make the client happy and will always do my best.

• Once the commission is finished, I can only do small changes such as color adjustments and/or add tiny details that I may have forgotten.

• I will make changes to the final piece if there has been an error in the piece which is on me (Details that were stated in the order).

• Any greater changes will come with an extra charge fee. (Ex: Poses, Outfit change or addition/subtraction, background change (excluding minimalist/simple background), or anything that causes me to redraw it completely).

• If any major changes were to occur I will send out a second invoice to confirm the order.

V. COPYRIGHT/USAGE POLICY

• I, the artist, hold every right to the produced drawing and I hold the rights of the rigs I create, not the commissioner/client. I am allowed to promote myself on any social media and/or sites, to display it anywhere to my liking, and post it wherever I want.

• The client is allowed to use the copyrighted artwork/rig for personal use, unless otherwise

• The client is allowed to print the artwork and claim their character(s), not the drawing itself.

• The client is allowed to promote themselves with the proper credit given to the artist.

• If any of the following has been broken, I will take that as copyright infringement, and every right you had to the drawing with me will be retracted.

VI. CANCELLATION/REFUND POLICY

• I can refund 100% of the payment ONLY if I have not started working on the sketch or rig.

• I will refund if you have a reasonable excuse.

• I will refund based on what stage I am currently at.

• Digital Art: Not Started - 100%, Sketch - 65%, Line Art - 35%, Completed Art - NO REFUNDS

• Rigging (If I'm breaking pieces): Not Started - 100%, Pieces Broken Down - 45%, Completed Rig - NO REFUNDS

• If you have broken down the pieces for the rig and I have not started, it is considered a full refund.

By commissioning me, it means that you have read and accepted all the terms above.
You are agreeing to the policy of using the art for personal, non-profit purposes or commercial use and provide all image and/or rigging credit to me, ShockingNess.
